TRUST ADMINISTRATION

General trust administration, legal compliance, and governance

We provide comprehensive trust administration services, including serving on the board of trustees as an independent trustee, ensuring compliance with legislation, and establishing appropriate governance structures to ensure effective decision-making, management, and compliance.

We also provide general administrative services, which include making changes to the trust deed, board of trustees, registered addresses of trusts, and registered auditors or accounting officers. Our services include:

  • Drafting all supporting trust documentation and preparation of all required standard forms.
  • Filing changes to the trust with the Master of the High Court
  • Application for amended Letter of Authority
  • Dealing with queries from the Master of the High Court
  • Drafting of required Trustee Resolutions
  • Collation of FICA information packs.

General trust advisory services:

We can offer expert advice and guidance on trust administration, compliance with legislation, distributions, board compositions, trust planning, advice on tax trust rates, and governance, including interpretation of laws, regulations, and policies and the Trust Deed.  In addition, we provide guidance to Trustees on compliance with fiduciary duties.

Registration of trusts for tax:

We register trusts for income tax, and all other tax types (if required).

Dissolution and deregistration of trusts:

We assist with the legal dissolution of trusts, including final distributions and deregistration of the trust with both the Master of the High Court and SARS.

In-house legal trust advisory services, opinions, and memorandums:

We provide expert legal advice and guidance on all aspects of trust administration, compliance with legislation, and governance, including providing opinions and memorandums on legal and trust taxation matters.

Safekeeping of records:

We ensure the safekeeping of all trust records, registers, and minutes books to ensure that they are easily accessible and in compliance with legislation.
